Terms of Service

Last updated: 5 November 2026

These Terms govern your use of the website at neokalos.com.au (the "website"), operated by Neokalos Pty Ltd (trading as Neokalos, "we", "us", "our"). Services we provide to clients are governed by separate written agreements.

1. About us

The website is operated by Neokalos Pty Ltd, Australia. Contact: warren@neokalos.com.au.

2. Acceptance

By accessing or using the website you agree to these Terms. If you do not agree, please do not use the website.

3. Information only

The website provides general information about Neokalos and our services. It does not constitute professional advice, and nothing on the website is an offer capable of acceptance. Any engagement is subject to a separate written agreement.

4. Intellectual property

Unless stated otherwise, the content, design, graphics and code of the website are owned by or licensed to Neokalos Pty Ltd. You may view and share pages for personal, non-commercial purposes; any other use requires our prior written permission. Third-party names are used for identification only and remain the property of their owners.

5. Acceptable use

You must not misuse the website, including by attempting to gain unauthorised access, introducing malicious code, interfering with its operation, or using it for any unlawful purpose.

6. Third-party links

The website may link to third-party websites. We do not control and are not responsible for their content or practices.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified (Non-excludable Rights).

8. Disclaimer

Subject to the Non-excludable Rights, the website is provided on an "as is" and "as available" basis and, to the maximum extent permitted by law, we exclude all warranties, representations and guarantees that are not expressly set out in these Terms, including that the website will be uninterrupted, error-free or free of harmful components.

9. Limitation of liability

Subject to the Non-excludable Rights, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss or damage, or for loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the website.

Where our liability for a breach of a Non-excludable Right can lawfully be limited, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.

10. Client engagements

Where we provide services under a separate written agreement, that agreement prevails over these Terms to the extent of any inconsistency in relation to that engagement.

11. Governing law

These Terms are governed by the laws in force in Australia. You submit to the non-exclusive jurisdiction of the courts of Australia and courts entitled to hear appeals from them.

12. Changes

We may update these Terms from time to time by publishing a new version on this page. Your continued use of the website after an update constitutes acceptance of the updated Terms.
